PLANS to convert a former pub into holiday accommodation are to be reconsidered following a High Court ruling.

Permission was granted in December for the proposals at the Blue Ball Inn, in Triscombe, near West Bagborough.

But planners at the now defunct Somerset West and Taunton Council (SWT) did not follow the correct procedures when they agreed to allow the owner to create holiday let along with ancillary bar and community use.

SWT blamed an "administrative error" for allowing the change of use application to be considered under delegated powers.

But, due to the number of objections, it should have been referred to the council's planning committee to be decided by councillors.

The applicant, Grant Fowler, was made aware of the problem and received an apology from the council.

The proposals will now be debated by the planning committee at Somerset Council, which was created when SWT and the other district council and Somerset County Council were axed earlier this year.

A Somerset Council spokesperson said: "As it is not possible for the local planning authority to withdraw a planning permission once issued, a legal process was initiated through the High Court to quash the decision.

"The successful judicial review of the decision means the planning application can now be considered for redetermination by members of the new Planning Committee West set up by Somerset Council.

"The application is likely to go to Planning Committee West at its meeting on July 18."

The council has not revealed the cost of the High Court action to correct the mistake.
