A CONVICTED drink-driver who was caught drunk behind the wheel for a second time near Shepton Mallet has been given a 40-month driving ban.
Charlotte Marshall-Folkes narrowly avoided a collision with another vehicle on the Old Frome Road in Doulting and then skidded and flipped her vehicle over.
She was disorientated and appeared to be intoxicated, then gave a positive roadside breath test. However, by the time she was taken into custody she was under the limit.
Marshall-Folkes, 31, living care/of an address in Fosse Way, Hornblotton, admitted driving a vehicle on February 6 while unfit to drive through drink when she appeared in court at Yeovil.
District judge Angela Brereton was told that a witness was driving on Old Frome Road when she saw the defendant’s vehicle travelling straight towards her before it lost control skidded and then flipped over.
She was described as being disorientated, had a head wound and appeared to be intoxicated and admitted she had been drinking.
After giving a positive breath test at the roadside a further test at the police station showed she was under the drink drive limit. The court also heard that Marshall-Folkes had a previous conviction for an identical offence in 2017.
Defending solicitor Greg Peters said that his client was currently “sofa-surfing” and was now abstinent from alcohol having not drunk since the incident.
She was sentenced to a 40-month driving disqualification along with a 12-month community order with 15 Rehabilitation Activity days.
She was also fined £75 and ordered to pay a£114 victim surcharge and £40 towards costs.
